director wants job back

SEYMOUR — Former Finance Director Arthur Davies notified the town Friday that he wants to come back to work, even though town officials likely will fire him.
On Tuesday the Board of Se-lectmen voted to reestablish the full-time finance director posi-tion. Under the town’s civil service ordinance, the job had to be offered first to Davies, who was laid off in February after the town’s fiscal woes came to light.
Attorney Stephen J. Courtney of Hamden, who represents Davies, said his client is "willing and able to go back to work." He said he expects Davies will return Nov. 15, as specified by the selectmen.
But First Selectman Scott Bar-ton said he will ask the select-men to terminate Davies, who oversaw the town’s finances when Seymour fell from a $4.5 million surplus to a $186,000 deficit in fiscal year 1998.
Barton said he plans to make the recommendation Oct. 17, before Davies even has a chance to get back behind his desk.
"I’m not going to say another word about this until the meeting," Barton said Friday.
Courtney said Davies was told he was laid off because of the town’s lack of funds and not due to his performance.
"He did nothing inappropri-ate, illegal or incompetent," Courtney said.
Town officials sent a letter to Davies last week to inform him of the town’s decision to re-open the position. He had 10 days to decide if he wanted his old job back.
The selectmen said they re-opened the position based on recommendations made in a special audit of the town’s fi-nances by Checkers Interna-tional Inc. of Fairfield.
The audit report said Davies was one of the key figures re-sponsible for the town’s debt.
The audit recommends the town hire a finance director who is a certified public ac-countant. Davies, who owns Art Davies Real Estate in Ansonia, is not a CPA.
Courtney said that if the se-lectmen terminate Davies, his client "will have to decide at that time if he will seek legal remedies."
Finance Director Anthony Caserta is serving as acting finance director.
